Dispute Resolution Center (DRC) - Modern Standard Arbitration

Georgia aims to build European standard democratic state, where the rule of law is ensured and Georgia is presented in the region as the county with judicial institutions of international standards, as well as regional financial and economic center. In order to achieve this objective, it is vital that alternative dispute resolution center with international reputation operates in Georgia.

In the beginning of 2014 Business Association of Georgia became the partner of the Arbitration Institute Dispute Resolution Center. On the one hand, this has united the biggest and leader companies, businessmen in their fields and on the other hand, professionals having appropriate reputation and qualification under a single idea – transforming Tbilisi into a regional center for resolving international commercial disputes and developing DRC into an institute for resolving international commercial disputes. It is worth mentioning that in business and civil relations a huge importance is attached to speed and the form of resolving disputes in the course of dispute proceedings. One of the main significances of arbitration is to resolve the dispute rapidly and with less expenditure.

 

DRC – Dispute Resolution Center offers business its services through arbitration and mediation

DRC operates since 2008 and is characterized with high professionalism and reputation. Arbitration institute arbiters contributed greatly to the establishment of Georgian Arbiters’ Association in 2013, which has elaborated and adopted “Arbiters’ Code of Ethics”. DRC advices business subjects to choose arbitration as the possible mechanism for dispute prevention and dispute resolution. If parties agree that the dispute might be resolved by the “Dispute Resolution Center”, they are well aware that in case of a dispute, the latter will be resolved rapidly and with less expenditure by the independent, impartial and professional arbiters.

DRC is the only arbitration institution, which conducts electronic arbitration dispute proceedings. Parties to the dispute are able to handle dispute electronically: study case-files through DRC special electronic program, receive news concerning the case, present new evidences, etc. For businesses that have to conclude a number of agreements, it is very comfortable to initiate arbitration dispute without leaving the office and participate in it. 

DRC is the first arbitration institution in Georgia, which has a strong administration (DRC Secretariat). The secretariat insures appropriate support of arbitration dispute resolution and encourages parties to realize their procedural rights in full.

DRC is the first institution in Georgia that has set up the most important body – DRC Court within the arbitration Institutional structure. The Court carries out full administration of arbitration examination, supports the parties to arbitration dispute to set up Arbiters Tribunal, realize equal engagement and procedural rights in the course of arbitration examination, formally checks arbitration decisions and ensures archiving dispute case-files. 

DRC is the only institution in Georgia, which ensures the integration of its electronic arbitration program with respective programs of common courts. As a result, the party willing to enforce arbitration decision, is able to do it through DRC electronic program and does not need to address first an Arbiter and then the court in order to obtain the enforcement document on arbitration decision.

DRC has elaborated new rules for arbitration proceedings, which entered into force from January 2015. The rules contained last achievements in international commercial arbitration, as well as norms of the Code of Ethics of Georgian Arbiters’ Association. Business Association of Georgia hopes that business subjects will choose arbitration as the dispute resolution mechanism in their local and international commercial contracts in Georgia, as well as abroad.
